FTX Trading Ltd. (d/b/a FTX.com) and the FTX Recovery Trust have reached a settlement with venture capital firm K5 Global, resolving litigation initiated in June 2024. The agreement, announced on January 31, allows FTX to retain its investment in K5’s funds, which is expected to support ongoing creditor recovery efforts.
“Today’s settlement reflects another mutually beneficial solution to the broader issues raised during the collapse of the FTX group,” said John J. Ray III, Chief Executive Officer of the FTX Recovery Trust. “We are pleased to have reached an agreement with K5. Having spent extensive time with Michael Kives and Bryan Baum, co-founders of K5, it is clear that K5 is a bright spot in the FTX portfolio, and the expected strong performance of their investments will be a key driver in the recovery efforts for our stakeholders.”
FTX & K5 Global: Legal Dispute and Recovery Strategy
The legal dispute stemmed from a lawsuit filed by FTX in June 2023, seeking to reclaim $700 million invested in K5 Global by former FTX CEO Sam Bankman-Fried. The lawsuit was part of broader efforts to recover assets following FTX’s collapse in November 2022.
K5 Global, co-founded by Michael Kives and Bryan Baum, has an investment portfolio that includes major companies such as SpaceX, Anduril, and xAI. Despite allegations that Kives leveraged political connections to benefit Bankman-Fried, the settlement ensures FTX maintains its financial stake in the firm’s investments.
K5’s co-founders welcomed the resolution. “We appreciate the extraordinary professionalism and collaboration of John Ray and are grateful to have reached this settlement. We are proud of the role that K5 will play in the recovery process for all FTX stakeholders,” said Kives and Baum in a joint statement.
Future Outlook for FTX Creditors
The settlement is part of FTX’s broader recovery strategy, which involves liquidating assets and negotiating settlements to maximize creditor payouts. Under FTX’s Chapter 11 reorganization plan, which took effect on January 3, 2025, initial distributions to creditors are expected within 60 days, pending compliance with know-your-customer (KYC) and other regulatory requirements.
As FTX continues its financial restructuring, questions remain regarding the extent of asset recovery from K5 Global. Nonetheless, FTX leadership views the retained investment as a strategic component of its long-term recovery plan.
